Crl.O.P.No.18826 of 2023 G.CHANDRASEKHARAN.J., The petitioner namely Ravanan, who was arrested and remanded to judicial custody on 30.04.2023 for the offences punishable under Sections 420 and 379 of IPC in Crime No.135 of 2023 on the file of the respondent police, seeks bail.

2. The learned counsel for the petitioner submitted that, petitioner is an innocent person and he has been falsely implicated in this case. Petitioner is in Judicial Custody from 30.04.2023. Thus, he seeks bail to the petitioner.

The learned Additional Public Prosecutor submitted that, modus operandi in this case is that, on 22.04.2023, at about 11.00.a.m., defacto complainant tried to take print out of his bank statement at SBI ATM at Vettavelam. However, he was not able to take the print out. At that time, petitioner had come to the ATM and defacto complainant requested the petitioner to help him for taking print out. Petitioner tried to take print out and informed the defacto complainant that, he was not able to take print out and returned the ATM card to him and left. On 25.04.2023, defacto complainant visited the Bank and informed the Bank 1/4

Officials that his ATM Card was not working. On seeing the ATM Card, Bank Officials informed the defacto complainant that the card does not belong to him. On verification of account, totally a sum of Rs.1,59,000/- has been taken from various ATMs from 22.04.2023 to 24.04.2023. He further submitted that, apart from this case, there are 11 previous cases pending against the petitioner. Investigation in this case is pending.

4. It is seen that, this is the second bail petition filed by the petitioner. This Court on 26.07.2023, dismissed the petitioner's bail petition in Crl.O.P.No.16339 of 2023 on the ground that, apart from this case, there are 11 similar previous case pending against the petitioner and that investigation in this case is not completed. It is now reported that, out of Rs.1,59,000/- taken from various ATMs using defacto complainant's ATM card, only a sum of Rs.30,000/- was recovered and the remaining amount is not yet recovered. In the said circumstances, this Court finds no change of circumstances warranting this Court to consider the bail petition. Thus, this Court is not inclined to grant bail to the petitioner.
