Crl.M.P.No. 14070 of 2022 in Crl.O.P.No. 12546 of 2022 A.D.JAGADISH CHANDIRA.J This Court by order dated 09.09.2022 had directed the matter to be posted for "Reporting Compliance". The petitioner had approached this Court seeking anticipatory bail in Crime No.79 of 2022. This Court on the undertaking given by him, to show his bona fides that he was ready and willing to deposit a part of the amount had granted anticipatory bail to the petitioner on 10.06.2022 with a direction to deposit a sum of Rs.15,00,000/- to the credit of Crime No.79 of 2022 on the file of Judicial Magistrate, Puducherry, within a period of two weeks from the date on which the order copy made ready. The petitioner after obtaining bail on the basis of the undertaking to deposit Rs.15/- lakhs had earlier filed an application in Crl.M.P.No.

10330 of 2022 seeking to modify the condition imposed by this Court in Crl.O.P.No.12546 of 2022, dated 10.06.2022. This Court while refusing to modify the condition had extended time till 08.08.2022 to comply with the order passed in Crl.O.P.No.12546 of 2022, dated 10.06.2022. The petitioner, thereafter, had filed the petition in Crl.M.P.No.

order passed by this Court in Crl.M.P.No.10330 of 2022, dated 22.07.2022, this Court extended time for deposit till 02.09.2022. Subsequently, the petitioner had again filed Crl.M.P.No.14070 of 2022 seeking for extension of time till 31.10.2022 for depositing Rs.15,00,000/- .

When the matter was listed on 09.09.2022, this Court had extended the time till 23.09.2022 and directed that if the amount is not deposited on or before 23.09.2022, the anticipatory bail granted in Crl.O.P.No.12546 of 2022, shall stand automatically cancelled and no further extension of time will be granted and the matter was also directed to be listed for "reporting compliance" on 27.09.2022. When the matter is listed today 27.09.2022, it is reported by the learned Public Prosecutor, Pondicherry, that the order has not been complied with and the amount has not been deposited so far.

3. In view of the above, the anticipatory bail already granted in Crl.O.P.No.12546 of 2022, dated 10.06.2022 shall stands cancelled for non-compliance of the order.

4. The respondent/Police is directed to take appropriate steps in accordance with law.
