This Civil Miscellaneous Petition has been filed to set aside the order of dismissal dated 20.10.2021 and to restore the Second Appeal on file. 2.It is seen from the affidavit that unfortunately owing to various circumstances, the counsel could not appear before this Court and the Second Appeal had been dismissed for default. Immediately, after coming to know about such dismissal, this Civil Miscellaneous Petition has been filed.
3.In view of the fact that the Second Appeal had been admitted and the substantial questions of law had been framed, it would only be proper that the Court should answer the substantial questions of law. Hence the Second Appeal is restored back on file, giving an opportunity to the learned counsel for the appellants to address the Court on the substantial questions of law raised for consideration at the time of admission. The Civil Miscellaneous Petition is allowed.
