O.A.No.589 of 2022 in E.L.P.No.5 of 2021 M.SUNDAR.J., Mr.K.Sasindran, learned counsel for applicant, Mr.B.Arvind Srevatsa, learned counsel for first respondent/returned candidate and Mr.R.Arul Srivatsa, learned counsel representing Mr.Niranjan Rajagopalan of M/s.G.R.Associates (Law Firm) for Election Officers [Respondents 7 and 8] are before this Court.

2. It is to be noted that A.No.668 of 2021 seeking deletion of Respondents 7 and 8 was disposed of by this Court in and by order dated 29.08.2022. This order means that Respondents 7 and 8 will not be deleted and they will continue to be in the array of respondents. Therefore, it is necessary that 7th respondent is correctly described.

3. In this view of the matter, learned counsel for returned candidate very fairly submits that he is not opposing the prayer as it is formal in nature, as it is only a typographical error and it is innocuous. As regards the Election Officers, this Court is inclined to allow the application making it clear that this will not affect the rights of the Election Officers if they decide to assail the order dated 29.08.2022 made in O.A.No.668 of 2021 seeking deletion.

4. With the above rider, captioned application is ordered as prayed for. Election petitioner, who is the applicant in captioned application, to carry out necessary and consequential amendments on or before 11.10.2022.
