This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 19.07.2024, seeking bail in Crime No.406 of 2024 registered under Section 311 of BNS, 2023.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that even the name of the petitioner does not find place in the First Information Report and he has been suffering incarceration from 19.07.2024. Hence, he sought for bail stating that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court.

3. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner, who is arrayed as A3, along with two other accused waylaid the de facto complainant's father, assaulted him with knife and taken away Rs.60/- from him. He also submitted that the injured person is still taking treatment in the hospital and the case is still under investigation, therefore, if the petitioner is released on bail at this stage, there is a possibility of him absconding and not available for further proceedings. Hence, he opposed for granting bail to the petitioner.

4. Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) that the case is under investigation and the injured is still in hospital, this Court is not inclined to grant bail to the petitioner.
