The petitioner, who was arrested and remanded to judicial custody on 07.03.2025 seeks bail in S.C.No.222 of 2023 for the offence punishable under Sections 109, 395 and 397 of IPC in connection with Crime No.94 of 2023, registered on the file of the respondent.

Learned counsel for the petitioner submitted that the petitioner is an accused facing trial in S.C.No.222 of 2023 on the file of the Sessions Magalir Neethi Mandram ( Fast Track Mahila Court), Tiruppur. He further submitted that since the petitioner was ill, he was unable to appear before the trial Court, and he was issued with the non-bailable warrant on 07.11.2024 and pursuant to the same, he was arrested on 07.03.2025 through P.T warrant. He further submitted that the petitioner is a sole breadwinner of his family and due to his incarceration, his family is suffering. He further submitted that the petitioner undertakes to co-operate with the trial. Therefore, he prays for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent submitted that since the petitioner, facing trial in S.C.No.222 of 2023 on the file of the Sessions Magalir Neethi Mandram ( Fast Track Mahila Court), Tiruppur, has failed to appear before the trial Court, the trial Court has issued a NBW against the petitioner on 07.11.2024 and pursuant to the same, he was arrested on 07.03.2025 through P.T warrant. He further submitted that apart from this case, petitioner has several previous cases. Hence, he oppose for grant of bail to the petitioner.

4. Considering the facts and circumstances of the case and the bad antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner at this stage.
