The petitioner, who was arrested and remanded to judicial custody on 15.07.2022 for the offences punishable under Section 366 of IPC and Section 4 Protection of Child from Sexual Offence Act, 2012 in Crime No.14 of 2022 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner had committed penetrative sexual assault on the victim girl aged about 15 years. Hence, the case.
3. On the pretext of false marriage, the petitioner had committed penetrative sexual assault on the victim girl aged about 15 years. Further, she was left out in the railway station and thereafter, she was secured.
4. The learned Government Advocate (Criminal Side) appearing for the respondent submitted that this is the second bail petition. Earlier bail petition filed by the petitioner in Crl.O.P.No.21949 of 2022 was dismissed on 30.08.2022.
5. This Court, taking into consideration the facts and circumstances
of the case, had dismissed the earlier bail petition and now again he has filed a petition seeking bail. There is no change of circumstances to entertain the second bail petition. Hence, this Court is not inclined to grant bail to the petitioner.
6. Accordingly, this Criminal Original Petition is dismissed. 12.09.2022 Lpp/vsn
