(Crime No.65 of 2016) PRAYER: Contempt Petition filed under Section 11 of Contempt of Court Act, praying to issue summon to the respondent and punish him for the willful disobeying the order passed in Crl.O.P.No.20246 of 2017 dated 22.09.2017 under the provision of the Contempt of Courts Act. ORDER

The present petition is filed seeking to punish the respondent for having committed contempt of court by disobeying the order of this Court dated 22.09.2017 passed in Crl.O.P.No.20246 of 2017.

2. The earlier order of this Court dated 22.09.2017 passed in Crl.O.P.No.20246 of 2017 was for a direction to the respondent to file a charge sheet in Crime No.65 of 2016 dated 24.02.2016.

3. Today, when the matter was called, the learned Government Advocate (Crl. Side) had produced a copy of the final report dated 25.06.2019 filed before the learned Judicial Magistrate-II, Ponneri, reporting the complaint to have been closed as 'undeducted'.

4. In view of the closure of the petitioner's complaint, this Court finds that the disobedience alleged on the part of the respondent is not willful in nature. If at all the petitioner is aggrieved against such a closure, it is open to them to workout their remedies in accordance with law.
