This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 04.07.2024, seeking bail in Crime No.292 of 2024 registered under Sections 118(1), 296(b) @ 103 of BNS, 2023.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner is the son of the victim/deceased and even as per the complaint given by the deceased's second wife, the son-in-law of the victim/deceased has murdered the victim, whereas, the petitioner has been wrongly implicated in this case. He also submitted that even the name of the petitioner does not find place in the First Information Report and he has been suffering incarceration from 04.07.2024. Hence, he sought for bail stating that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court.

3. Learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the petitioner is the son of the deceased/victim and there was a property dispute between them. He also submitted that it is a case of murder and the same is under investigation. therefore, if the petitioner is released on bail at this stage, there is a possibility of him absconding and not available for further proceedings. 4. Taking into consideration the facts and circumstances of this case and the submissions made by the learned Government Advocate (Criminal Side) that the case is under investigation, this Court is not inclined to grant bail to the petitioner.
