Mr.K.Surendar, GA Order (Order of the Court was made by Dr.G.Jayachandran J.) (1) Mr.K.Surendar, learned Government Advocate accepts notice on behalf of the respondents. By consent, the main writ petition is taken up for final disposal at the admission stage itself. (2) Aggrieved by the order passed under Section 6 of the Tamil Nadu Land Encroachment Act, 1905, the petitioner herein has preferred a statutory appeal under Section 10 of the Act, before the District Collector, on 22.06.2026, along with a stay petition. While so, the present writ petition is filed on the next day, i.e., 23.06.2026, seeking a mandamus, directing the District Collector to consider and dispose of the aforesaid statutory appeal and the stay petition.
(3) The reason for invoking the extraordinary jurisdiction of this Court one day after filing the statutory appeal before the District Collector, remains unexplained.
(4) Hence, we find no plausible reason to exercise our power under Article 226 of the Constitution of India while the statutory appeal is pending before the District Collector.
(5) Accordingly, the writ petition stands dismissed. We have no doubt that the District Collector will consider and dispose of the statutory appeal on merits within reasonable time. No costs. Consequently, the connected miscellaneous petitions are closed.
