The petitioners, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 448, 147, 148, 294(b), 323, 324, 506(ii) @ 448, 147, 148, 294(b), 323, 324, 506(ii), 307 of I.P.C, in Crime No.250 of 2023 on the file of the respondent police, seeks anticipatory bail.
2.The case of the prosecution is that, on 22.07.2023 the petitioners and de-facto complainant got wild and started abusing and the de-facto complainant's husband was brutally attack in his body and was abused with filthy language. Hence the case.
3. The learned counsel for the petitioners submitted that the petitioners are an innocent person. They have been implicated falsely in this case. Hence, he prays to grant to anticipatory bail to the petitioners.
4. The learned counsel for the intervenor submits that the 1st respondent's wife was eloped with someone on 17.07.2023 and the respondents 1 to 7 are misunderstood that the de-facto complainant's younger son is the reason for the same and on 22.07.2023 at about 10.00P.M when the de-facto complainant's and her husband were at home the respondents 1 to 7 herein are criminally trespassed into her house and scolded in filthy https://www.mhc.tn.gov.in/judis 1/2
Crl.O.P.No.18149 of 2023 RMT.TEEKAA RAMAN,J., nvi languages and assaulted her with wooden stick and made a criminal intimidation. Hence, he vehemently opposed to grant anticipatory bail to the petitioners.
5.The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the investigation is in at preliminary stage. Hence, he opposed for grant of anticipatory bail to the petitioners. 6.Heard the learned counsel for the petitioners and the learned Government Advocate (crl.side) for the respondent police and perused the materials available on record.
7.Taking into consideration the facts and circumstances of the case, the submissions made by the learned counsel on either side and the nature of offence committed by the petitioners and the investigation is at preliminary stage, this Court is not inclined to grant bail to the petitioners. 8.Accordingly, this Criminal Original Petition is dismissed. Consequently, connected Crl.M.P is closed.
