The instant writ petition has been filed with a prayer for issuing a Mandamus directing the respondents to disburse the Provident fund amount, leave encashment amount Gratuity amount and Employees security deposit amount payable to the petitioner together with interest at the rate of 10% per annum from 30.11.2017 i.e., date of retirement to till the date of actual payment by considering the representation of the petitioner dated 09.06.2025.

The learned counsel for the petitioner would submit that the petitioner was appointed as Clerk on 01.10.1983 at Nadukuppam Primary Agriculture Co-operative Credit Society/3rd respondent, and he retired from service on 30.11.2017. In this connection, the petitioner has given various representations to disburse the terminal benefits such as Provident fund amount, leave encashment amount Gratuity amount and Employees security deposit amount payable to the petitioner, together with interest at the rate of 10% per annum from 30.11.2017 i.e., date of retirement till the date of actual payment, and such representations are yet to be considered by the respondents.

At this juncture, the learned Additional Government Pleader appearing for the 1st and 2nd respondents, on instructions from the 3rd respondent, has submitted that the petitioner is entitled to Rs.3,66,646/- towards the arrears in respect of EPF, Gratuity and Security deposit. Therefore, he seeks short accommodation to pay the aforementioned amount.

4. Heard the learned counsel for both sides and perused the materials available on record.

In view of the above fair submission, without going to the merits of this Writ Petition, this Court deems it appropriate to direct the respondents to settle the eligible amount within a period of 12 weeks from the date of receipt of a copy of this order. It is made clear that if there is any due to be paid by the respondents, the petitioner is given liberty to file an application before the appropriate forum.

6. In the result, this Writ Petition is disposed of with the above observations. No costs.
