The petitioner herein alleging harassment by the respondent Police in connection with Crime No.1311 of 2021, is before this Court seeking protection.

2. According to the petitioner, in Crime No.1311 of 2021 he was suspected and arrested. Later, final report filed in that case and he is shown as A2 in C.C.No.168/2024 on the file of Judicial Magistrate-II, Poonamallee. While so, the respondent police on 24.06.2024 came to his house and took him to the police station under the guise of investigation and kept him under illegal custody for three days. Stating that he is innocent person and carrying on lawful business, however, the police investigating a case in which one Karuppu is involved and disturbing his peaceful possession by frequently visiting the house.

3. The Learned Government Advocate (Crl.Side) for the respondents states that there is no complaint or petition pending against this petitioner and his presence is not required by the police. 2/4

4. Recording the statement of the Government Advocate (Crl.Side), that the T-4 Maduravoyal Police has no case and no complaint against this petitioner.

5. With this observation, this Writ Petition is disposed of directing the respondent police not to disturb the petitioner merely on suspicion. If at all his presence is required for any interrogation, he must be summoned as per law and interrogate in accordance with law.
