The learned counsel for the first respondent/claimant has brought to the notice of the Court that the claimant had preferred an appeal in C.M.A.No.1236 of 2002, seeking enhancement of compensation and it has been allowed by this Court on 19.07.2010. A copy of the said order was circulated to this Court
and the same is also perused by the learned counsel for the appellant and admitted to the factual correctness of the same. Inasmuch as the claimant's appeal has been allowed and the compensation is enhanced, nothing survives in this present appeal and the same is dismissed, but without costs.
