This petition has been filed to set aside the dismissal order and restore the above Second Appeal.

2. It is represented by the learned counsel for the petitioner/ appellant that when the Second Appeal was listed for admission, the same was dismissed for non-prosecution. This petition has been filed in time.

3. On being satisfied with the submissions made in the affidavit filed in support of the petition and also considering the submissions made by the learned counsel for the petitioner, this petition is ordered.
