THE HONOURABLE MR.JUSTICE B.RAJENDRAN WP.No.28880 of 2016 Muthuraja Petitioner Vs 1.The Tahsildar, Ulundurpet 2.Lakshminarayanan Respondents Prayer:- This Writ Petition is filed to issue a Writ of Mandamus to direct the 1st Respondent to effect change of patta in favour of the Petitioner in respect of S.No.481 (new S.No.481/1 - 1.31 acres) at Perumbakkam Village, Ulundurpet Taluk, on the basis of the representation of the Petitioner dated 28.9.2015.

ORDER

This Writ Petition is filed to direct the 1st Respondent to effect change of patta in favour of the Petitioner on the basis of his representation dated 28.9.2015.

2. This court heard the learned counsel on either side and also perused the materials placed on record.

3. According to the Petitioner, he had succeeded upto the second appeal and his rights have been declared and he has already applied for transfer of patta by application dated 28.9.2015, but till date, it is kept pending without even a reply.

4. The learned Additional Government Pleader for the 1st Respondent has submitted that the 1st Respondent will consider the application of the Petitioner if it is in the prescribed format and on payment of necessary fee.

5. The Petitioner's rights have been declared in the second appeal. Though the Petitioner made an application for transfer of patta, but he ought to have also paid the necessary fee in this regard. Therefore, the application of https://hcservices.ecourts.gov.in/hcservices/

the Petitioner for transfer of patta will by considered by the 1st Respondent on payment of necessary charges, after giving notice to the 2nd Respondent, on merits and in accordance with law, within a period of four months from the date of receipt of a copy of this order.

6. With the above directions, this Writ Petition is disposed of. No costs.
