PRAYER : Writ Petition has been filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondents 1 & 2 to grant police protection to the 3rd respondent for survey, measure and demarcate the property ad measuring 44 1⁄2 cents comprised in Sy. No.54/2D, 37 1⁄4 cents Page No.1/4

comprised in SY. No.51/4 and the property ad measuring 16 1⁄2 cents with 1/3rd right in the well and channel right and electricity service connection comprised in Sy. No.51/6 situated at Kaisnaykanpatti Village, Kandili Panchayat Union, For Petitioner : Mr.B.Rajarajan For Respondents 1 to 3 : Mr.S.Udaya Kumar, Government Advocate (Crl.Side)

ORDER

The Writ Petition is filed seeking police protection to measure and demarcate the properties mentioned in the Writ Petition. Based on the compromise decree, the petitioner herein wants to demarcate the property. The surveyor has given notice to the parties, calling for objection if any, for measuring the land.

2. It appears that the survey number sought to be measured and demarcated differs from survey number found in the compromise decree and therefore, no action is to be taken on the representation of the petitioner.

3. In view of the above facts, this Court finds no reason to entertain the writ petition and it is open to the petitioner herein to make proper representation to the appropriate authority namely Tahsildar and Surveyor for measuring the lands with all necessary documents and if they are satisfied, the Page No.2/4

surveyor can measure the land and demarcate it and in case if there is any disturbance, the police shall act on the request of the surveyor in accordance with law .
