ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner who was arrested and remanded to judicial custody on 19.02.2020 for the offences under Section 454 and 380 of IPC, in Crime No.394 of 2019, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner has stolen 167.75 sovereign of gold jewels from defacto complainant's home. Hence the complaint.

3.The learned counsel for the petitioner would submit that the petitioner is a driver and he has been falsely implicated in this case. He would further submit that the petitioner has been suffering incarceration for more than 1 1⁄2 years from 19.02.2020 and that he is prepared to abide by any stringent condition and would pray for grant of bail to the petitioner.

4.The learned Government Advocate (Crl. Side) would raise objection stating that petitioner is arrayed as A5 and he is already having 19 previous cases and if he released on bail, there is every possibility of the petitioner getting abscond and the investigation would be stalled.

5.Considering the nature of offence and the antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
