The present miscellaneous petition has been filed seeking to condone the delay of 78 days in preferring the above Criminal Appeal as against the judgment of the learned Judicial Magistrate, Fast Track Court, (Magistrate Level) at Alandur made in C.C.No.328 of 2017 dated 15.03.2023.

2. Though name of the respondent was printed in the cause list, he has not entered appearance either in person or through counsel.

3. Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed.

4. Registry is directed to number the Criminal Appeal, if the papers are otherwise in order and list the same for admission.
