Prayer:- Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the 1st respondent to consider the petitioner representation dated 02.07.2012 and consequently, direct the 1st Respondent to prevent the 3rd respondent from in any manner unauthorisedly putting up borewell in the 5 feet common pathway at Pushpa Nagar Main Road, Nungambakkam, Chennai-34, which belongs to the Tamil Nadu Slum Clearance Board.

[Order of the Court was made by M.SATHYANARAYANAN, J.,] The learned counsel for the petitioner would submit that in the light of the interim order passed by this Court, the place identified for putting up the Borewell, has been closed and the 3rd respondent, on whose instance, it was sought to be laid, has also vacated the premises and in the light of the subsequent development, nothing survives for further adjudication in this writ petition.
This Court heard the submissions of Mr.S.Prabhu, learned Standing counsel appearing for the 1st respondent ; Mr.G.Janakiraman, learned Standing counsel appearing for the 2nd respondent and Mr.A.N.Thambidurai, learned Special Government Pleader appearing for the respondents 4 and 5 and perused the materials placed before it.
In view of the submission made by the learned counsel for the petitioner and in view of the subsequent development, nothing survives for further adjudication in this writ petition and accordingly, the same is closed. The interim order granted by this Court in MP.No.1/2012 is vacated and the said miscellaneous petition is closed.
