ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Section 147, 341, 294(b), 323, 324, 387, 506(II) IPC in Cr.No.1260 of 2021 on the file of the respondent police, seeks anticipatory bail.

2.The case of the prosecution is that while the defacto complainant and two others were returning back from the funeral of their close relative, due to previous enmity, the petitioner along with other accused persons waylaid the defacto complainant and two others and abused them in filthy language and threatened them with knife point and snatched an amount of Rs.10,000/- and one gram of gold from the defacto complainant and also attacked his cousin in his head and in the said attack, the defacto complainant's cousin sustained grievous injuries. Hence, the defacto complainant lodged a complaint against the petitioner.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. 4.The learned Government Advocate submitted that the injured has been discharged from the hospital however, there are five previous cases pending against the petitioner and the other accused persons are absconding. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Considering the fact that the injured has been discharged from the hospital however, considering the previous cases pending against the petitioner and since, the other accused persons are absconding, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the petition seeking anticipatory bail is dismissed.
