The petition to condone the delay of 794 days is taken up for consideration. The suit for partition and the preliminary decree is challenged in this appeal regarding the mode of division.

2. Though the respondents have been served with notice, there is no representation. Insofar as the first respondent is concerned, he is reported dead. Considering the nature of the dispute and the reasons stated for the delay in view of Covid-19 pandemic, the petition stands allowed.
