2. Though notice was served on the first and his name is printed in the cause list, there is no representation on his behalf.

3.Mr.P.Suresh Srinivasan learned counsel appearing for the second respondent did not raise any serious objection in allowing this petition. 4.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 14 days in filing the above appeal is condoned.

5. Registry is also directed to number the main Civil Miscellaneous Appeal, if it is otherwise in order, and print the name of Mr.P.Suresh Srinivasan, learned counsel for the second respondent in the cause list and list the same for admission in due course.
