Respondents Petition filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus to direct respondents 1 to 3 to restrain / prevent the 4th respondent or his men or agents or anybody or person acting on his behalf or instructions from doing any kind of illegal sand / gravel quarrying in Survey No.226, 224/1 228 Tank Bund Poramboke lands and R.S.No.224 Canal Poramboke and consequently direct respondents 1 to 3 to assess the damage already caused and restore/repair the same to its original condition within a time frame fixed by this Court and recover the same from the 4th respondent.

O R D E R

(Order of the Court was made by The Hon'ble Chief Justice) Though none appears for the petitioner, the counteraffidavit is available on record, which suggests that there is absence of illegal mining as alleged. There is stated to be some unauthorised construction, which is also stated to have been removed.

2.The petition is stated to be a consequence of the petitioner and the fourth respondent having past animosity, the petitioner having lost in the panchayat election in 2006. 3.Writ petition is, thus, dismissed.
