When the matter was taken up for hearing, the learned counsel for the petitioner, on verification, submitted that already criminal case is pending against the petitioner.

2. The learned Additional Government Pleader appearing for the respondents 1 and 2 submitted that as many as 12 witnesses have been examined and the case is still pending against the petitioner. According to the Additional Government Pleader, if a criminal case is pending against a person, he will not be eligible for promotion.

3. In view of the same, no further order is required. The petitioner would become eligible for promotion only depending
