Respondent PRAYER: Criminal Original Petition filed under Section 439 (1) (b) Cr.P.C. praying to modify the condition imposed by the Principal District and Sessions Judge at Tiruvallur by its order dated 26.07.2023 in Crl.M.P.No.3219 of 2023 as the petitioner shall depositing a sum of Rs.50,000/- before the District Munsif cum Judicial Magistrate, Uthukkottai to the credit of crime No.141/2023.

This petition is filed to modify the condition imposed by the learned Principal District and Sessions Judge, Tiruvallur, by order dated 26.07.2023, in Crl.M.P.No.3219 of 2023, that the petitioner shall deposit a sum of Rs.50,000/- before the District Munsif cum Judicial Magistrate, Uthukottai, to the credit of Crime No.141 of 2023.

2.The learned counsel for the petitioner submitted that the same condition imposed on the other accused was modified by this Court in Crl.O.P.No.13877 of 2023, dated 23.06.2023. Therefore, he seeks modification of the condition imposed on the petitioner that the petitioner shall deposit a sum of Rs.50,000/- before the District Munsif cum Judicial Magistrate, Uthukottai, to the credit of Crime No.141 of 2023. 3.This Court finds from the order passed in Crl.M.P.No.3219 of 2023, dated 26.07.2023, by the learned Principal District and Sessions Judge, Tiruvallur, that during the incident, property worth of Rs.2,00,000/- was damaged. In the said circumstances, this Court is not inclined to modify the condition totally. However, the condition is modified to the extent that instead 2/4

of Rs.50,000/- petitioner is directed to deposit a sum of Rs.25,000/- before the District Munsif cum Judicial Magistrate, Uthukottai, to the credit of Crime No.141 of 2023.
