This petition has been filed to condone the delay of 84 days in filing the application to restoration of above C.R.P., which was dismissed for nonprosecution on 15.04.2019 by this Honourable Court.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondent.

3. Learned counsel for the petitioner would submit that due to the health condition of the counsel on record, as he had to undergo a surgery and he was hospitalised, he could not appear on the date of hearing. He could not inform the development to the party and only thereafter, after his recovery from illness, he has taken steps through the party and filed the present petition to condone the delay.

4. The reason stated by the learned counsel for the petitioner is accepted. Accordingly, this petition is ordered and the delay is condoned. Registry is directed to number the restoration petition, if the papers are otherwise in order and list the same on 20.11.2019.
