O R D E R

The civil revision petition seeks for expeditious disposal of I.A.No.3 of 2021 in O.S.CFR.No.10337 of 2021 on the file of the learned Principal District and Sessions Judge at Coimbatore.

2. When the matter came up for admission on 06.12.2024, I called for a report from the learned Principal District and Sessions Judge to state as to how long she requires to dispose of I.A.No.3 of 2021 in O.S.CFR.No.10337 of 2021.

3. The learned Principal District Judge at Coimbatore has sent a report stating that the plaintiffs presented the suit in O.S.CFR.No.10337 of 2021 along with I.A.No.2 of 2021 seeking for permanent injunction. A counter has been filed on 10.11.2021. Meanwhile, an application in I.A.No.3 of 2021 in I.A.No.2 of 2021 under Order XXXIX Rule 1 & 2 of C.P.C. was filed by the plaintiffs. Thereafter, I.A.No.5 of 2022 in I.A.No.2 of 2021 has been filed seeking for impleading the other trustees 2/4

as parties. All those applications are pending. The report further states that on 10.12.2024, I.A.No.3 of 2021 was dismissed for default. On 13.12.2024, the petitioner filed a petition for restoration and the same was pending. Therefore, she requests two months time to dispose of I.A.No.3 of 2021 in O.S.CFR.No.10337 of 2021.

Taking into consideration the report of the learned Trial Judge, there shall be a direction to the learned Principal District and Sessions Judge at Coimbatore to dispose of I.A.No.3 of 2021 in O.S.CFR.No.10337 of 2021 within a period of two months from the date of receipt of a copy of this order.

5. Accordingly, the civil revision petition stands ordered. No costs. Consequently, connected miscellaneous petition is closed. 06.01.2025 Index:Yes/No Speaking order/Non-speaking order kj 3/4
