On the complaint given by one Madhu Malar, Police has registered the case in Crime No.2 of 2020 on 18.02.2020 for offence under Section 498A and 406 of IPC against Ramesh, the husband of the complainant, Chinadurai, father-in-law, Kasiammal, Mother-in-law and Thavamani, Sister-in-law.

2. Police on completion of investigation filed final report on 27.02.2021 and the same was taken on file as CC No.1741 of 2022 on the file of Additional Mahila Court, Coimbatore. 2/5

3. Being a matrimonial dispute, it appears that the defacto complainant and the accused persons have come to terms and settled their disputes amicably and entered into MOU on 24.07.2024. As per the MOU, the defacto complainant has agreed to withdraw the criminal case against the petitioners herein. She has filed an affidavit regarding the fact and her no objection to quash the charge sheet in CC No.1741 of 2022 dated 27.02.2021 pending on the file of Additional Mahila Court, Coimbatore. The Defacto complainant Madhu Malar is present before this Court. The accused persons are also present.

4. The learned counsel appearing for the parties report that petition to dissolve the marriage by mutual consent has been filed before the Family Court and the same is pending. Since the parties have arrived at settlement and part away amicably. The complainant wants to withdraw the case against the petitioners and has filed an affidavit to that effect. 3/5

5. Taking into consideration the facts and circumstances of the case, the criminal original petition to quash is allowed in the light of the affidavit filed by the defacto complainant Madhu Malar. Consequently, the connected miscellaneous petition is closed. 24.09.2024 jv Index : Yes/No : Yes/No To
