ORDER

The petitioner apprehends arrest for the alleged offence under Sections 318(4) of BNS and 66D of Information Technology (Amendment Act), 2008 in Cr.No.20 of 2025 on the file of the respondent police. seeks anticipatory bail.

2. The case of the prosecution is that the petitioner joining hands with group of persons involved in running on-line investment fraud and they have handled several bank accounts of various persons and money was collected through various persons. It is alleged that the total amount involved in this case is 16.86lakhs, which led to the registration of the FIR. Hence, the present case.

The learned counsel appearing for the petitioner submitted that the petitioner is not having any bank account in his name and it is alleged that he has handled one of the bank accounts and handed over the bank account details of other persons after receiving money to one another accused. He was not aware about the alleged online investment fraud. He further submitted that the petitioner is ready and co-operate with the investigation and prays to grant anticipatory bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that the total amount involved in this case is Rs.16.86lakhs and portion of the money transferred into the bank account of one Razia. Her account was handled by several accused by transferring the bank details and mobile phone with some 2/5

other persons. Finally, the same was reached to one Sadam Hussain. Before the bank account reaches the Sadam Hussain, it was handled by this petitioner and the petitioner admitted before the respondent police that he collected Rs.4,000/- Sadam Hussain and handed over the four numbers of bank account; pass book, 4 numbers of sim card .It is further submitted that regarding the money trail, investigation is pending. Hence, she opposed the grant of anticipatory bail to the petitioner.

I have also gone through the FIR and other connected materials including the status report filed, which revealed that group of persons worked with this petitioner jointly and handled 4 numbers of bank account and four sim cards and they have involved in online investment fraud. Though the petitioner has stated that the petitioner has collected Rs.4000/- and handed over the bank accounts and sim cards and he has not benefited, the reasons for handing over the bank pass book and four numbers of sim card itself is required to be sufficiently investigated by the Investigating Officer. The nature of offence is a complicated one and it requires investigation on various lines from the bank and on the on-line platforms etc, I am of the view that if the petitioner is granted anticipatory bail, it would hamper the investigation. Hence, I am not inclined to grant anticipatory bail to the petitioner.
