This writ petition has been filed seeking for the issuance of a Writ of Mandamus directing the first respondent to initiate action against the second respondent to de-freeze the petitioner's bank account.
2. Heard both.
3. The second respondent filed a detailed counter affidavit along with a typed set containing relevant documents.
4. On going through the same, it is seen that a current account was opened with the second respondent on 27.5.2025 in the name of one M/s.M.G.Legend Steels and Trading owned by Mr.P.Ganeshan. The account opening declaration stated that the business was for the sale of metals and steel. Thereafter, the second respondent found that there were several suspicious fund transfers that had taken place. As a result, an amount of Rs.29 lakhs came down to Rs.17,07,000/-. That apart, when an explanation was sought for, the petitioner submitted certain documents and the second respondent bank further found that 2/5
there were a lot of discrepancies in the documents that were furnished. In order to ensure that the second respondent does not get into any trap, they had chosen to freeze the bank account of the petitioner with effect from 11.6.2025.
5. In the considered view of this Court, the second respondent is not comfortable in continuing with the bank account of the said M/s.M.G.Legend Steels & Trading. Therefore, no useful purpose will be served for the petitioner in continuing to hold the current account with the second respondent. It is left open to the petitioner to open a fresh account in some other bank for smooth account transactions.

In the light of the above, the writ petition is disposed with a direction to the petitioner to submit an application before the second respondent requesting to close the bank account of the said M/s.M.G. Legend Steels and Trading. On receipt of the same, the second respondent shall close the bank account by either handing over the amount that is lying in the current account of the account holder or transfer the same to any other bank, in which, the account holder is having an account. By undertaking this exercise, the relationship 3/5
between the petitioner and the second respondent will come to an end. This exercise will also ensure a closure for the present dispute. No costs.
