This Criminal Original Petition is filed to set aside the order of dismissal passed by the learned XVI Additional Metropolitan Magistrate, Egmore in Crl.MP.No.23630 of 2024 dated 26.04.2024. 1/4
2. The learned counsel appearing for the petitioner states that since the investigation completed and final report filed, there is no purpose for the petitioner to report before the Investigating Officer on the 1st working day of every month.
3. The learned Government Advocate (Crl.Side) submits that during the period of investigation, the petitioner has fully cooperated and complied with the bail conditions i.e., reporting before the Investigating Officer twice daily and thereafter every Monday. Since the final report already filed and taken cognizance the condition may be imposed ensuring the appearance of the petitioner on the hearing dates.
4. Recording the same, this Criminal Original Petition is disposed of with condition that the petitioner shall attend the court personally on every hearing date without fail. If there is any reason for non appearance, the application must be filed under the appropriate provision of law before the learned Magistrate for the leave of absence. 12.08.2024 Vv 2/4
