ORDER

This writ petition has been filed for issuance of a mandamus to the first respondent to dispose of the appeal filed by the petitioner on 30.01.2025 within the time frame fixed by this Hon'ble Court.

2. Heard the learned counsel for petitioner and the learned Additional Advocate General appearing on behalf of the respondents.

3. The petitioner was aggrieved by the issuance of legal heirship certificate dated 23.12.2024 by the second respondent without including the name of the petitioner. Hence he filed an appeal before the first respondent, which was taken on file in Reference No.5066/2024/A4 dated 13.02.2025. The grievance of the petitioner is that till date, the first respondent has not

taken any decision and aggrieved by the same, the present writ petition has been filed before this Court.

4. The learned Additional Advocate General appearing on behalf of the respondents 1 & 2 produced the written instructions received from the second respondent.

5. On going through the same, it is seen that the petitioner had attended the enquiry and his statement has also been recorded. However, the other interested parties are not attending the enquiry and therefore, the first respondent is not in a position to pass final orders.

6. In the considered view of this Court, the first respondent can make one more attempt to call the other interested parties for enquiry and if they do not cooperate, the same shall be recorded in the order and the claim made by the petitioner can be independently considered and a decision shall be taken in accordance with law, within a period of six weeks from the date of receipt of a copy of this order.

7. This writ petition is disposed of with the above direction. No costs. Index : yes/no 08.07.2025 ss To
