The petitioner, who apprehends arrest at the hands of the respondent police for the offence punishable under Sections 3(2)(a), 3(2)(b), 4(1) and 5(1)(a) of Immoral Traffic (Prevention) Act, 1956, & 370 IPC in Crime No. 277 of 2023, seeks anticipatory bail.
2. The case of the prosecution is that based on the secret information, the respondent police went to Stan Palace Lodge at Velankanni Bus Stand, and on search, they found that the petitioner along with one Kalaivasan/A3, who is working as Room Boy induced one lady to the brothel and was involved in physical affair. Hence the case.
3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner is working as Manager in the said lodge and he has nothing to do with the alleged offence. He would also submit that A3 was arrested and remanded to judicial custody and thereafter, he was released on bail in Crl.O.P.No.16579 of 2023
dated 26.07.2023. Hence, he prays for grant of anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) for the respondent police would submit that the petitioner along with other accused, under the guise of running a lodge, was found in indulging prostitution. He would further submit that A1 and A3 were arrested and remanded to judicial custody and thereafter, A3 was released on bail. However, he vehemently opposed to grant anticipatory bail to the petitioner.
5. Considering the nature and gravity of offence committed by the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, this criminal original petition is dismissed. 24.08.2023 ata RMT.TEEKAA RAMAN,J.
