M.DHANDAPANI, J The petitioner was arrested on 18.08.2020 for the alleged offences under Sections 8(c) r/w 20 (b)(ii) ( c) and 25, 29(1) of Narcotics Drugs and psychotropic Substances Act, 1985 in Crime No.3789 of 2020, on the file of the respondent/Police, seeks bail.

2. Totally there are 3 accused in this case and the petitioner herein is A2 @ A1. The case of the prosecution is that when the respondent police on specific information went to the check post and intercepted a Van bearing Registration No.TN 64 P 1042 and found the petitioner was in possession of 451 kgs of Ganja. Hence, the complaint was registered. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case and he further submitted that the petitioner has suffered from health ailments and he requires medical treatment to his illness and on that ground also, he prays to grant bail to the petitioner. 1/4

The learned Government Advocate (Crl.Side) would submit that the petitioner was in possession of 451 kgs of Ganja which is of commercial quantity and this is a second bail application filed by the petitioner and there is no change of circumstances arises for consideration and hence, he vehemently opposed for grant of bail to the petitioner.

Considering the fact that the quantity of contraband seized was 451 kgs which is of commercial quantity, this court is not inclined to grant bail to the petitioner and further considering the request made by the learned counsel appearing for the petitioner, this Court is inclined to issue direction to the prison authorities to give proper treatment to the petitioner and further if they are not able to give proper treatment in the prison hospital, the petitioner may be admitted in Rajiv Gandhi Government General Hospital or Tamil Nadu Government Multi Super Speciality Hospital, for better treatment.

6. Accordingly, this criminal original petition is dismissed with the above observation.
