This petition is filed to enlarge the petitioners on bail in Crime No.108 of 2023 on the file of the respondent Police. 2.It is the submission of learned counsel for the petitioners that petitioners are falsely implicated as accused in Cr.No.108 of 2023 for the offence under Section 302 IPC. First petitioner is the son of the deceased Dharmaraj. Petitioners are in judicial custody from 10.07.2023. Thus, this petition is filed for seeking bail.

3.In response, the learned Additional Public Prosecutor submitted that the petitioner is the son of the deceased. There were frequent quarrel between them. The first petitioner had changed car of the deceased in his name and that caused further friction in the relationship. Therefore, on 09.07.2023 at about 07.00 p.m. first accused had instigated his friend to kill the deceased. In turn, second accused had hit the deceased on his back side of the head and caused injuries. Due to the injuries suffered, the deceased died. Investigation in this case is pending.

4.Considered the rival submissions and perused the records. 5.This case was registered only on 10.07.2023. The allegation against the petitioners is that in connection with the dispute with deceased, at the instigation of the first accused, the son of the deceased, second accused had hit the deceased on his back side of the head and caused his death. Investigation in this case is in preliminary stage.
