The prayer in the writ petition is to issue a Writ of Mandamus directing the 3rd respondent to return back all the original certificates of the petitioner along with the transfer certificate to continue his further studies without any fault pursuant to the petitioner representation dated 31.07.2019. https://hcservices.ecourts.gov.in/hcservices/

There is no representation for the petitioner. 3.The learned counsel appearing for the first respondent/Anna University as per the direction of this Court, caused notice to the third respondent, who did not appear before this Court despite notice. The third respondent has communicated the University, vide letter dated 23.08.2019, wherein it is stated that the petitioner who has availed the Government scholarship of Rs.80,000/- for his study wants to discontinue the course. Hence, he is liable to return back the scholarship amount paid to him. Since he has not sofar repaid the scholarship amount, they are not able to issue transfer certificate to the petitioner.

4. The reason for withholding the transfer certificate appears to be genuine. There is no violation of direction given by AICTE and Anna University regarding withholding the transfer certificate, since the scholarship amount paid to him from the Exchequer and if the candidate voluntarily discontinues the course, he is bound to repay the scholarship amount, which he received. The petitioner without repaying the scholarship amount, cannot ask for transfer certificate. Hence, this writ petition is dismissed. No costs.
