O R D E R

This petition has been filed to direct the second respondent not to harass the petitioner and his family members except by due process of law by considering the representation of the Petitioner dated 08.11.2021 on the file of the First Respondent herein.

2. The grievance of the petitioner is that the petitioner had taken a loan of Rs. 25,00,000/- from one Mr.Padmanaban by way of a simple mortgage deed. The petitioner only knows to read and write Tamil. At the time of the execution of the mortgage deed, signature of the petitioner was obtained in blank stamp papers. petitioner had signed the blank papers and handed over it to Mr.Padmanaban. Now the said Mr. Padmanaban has created an agreement for a sum of Rs. 65,00,000/- instead of Rs. 25,00,000/-. On the complaint of Mr.Padmanaban, the petitioner was called for enquiry. Hence, the petition.

3. The learned Additional Public Prosecutor submits that the petitioner shall appear before the respondent Police along with the documents and offer his explanation.

4. At this stage, the learned counsel of Petitioner on instructions, submitted that the petitioner is ready to appear before the respondent Police on 06.12.2021.

5. In view of the same, the learned counsel for the petitioner is directed to appear before the respondent Police on 06.12.2021 along with relevant documents and the respondent Police shall enquire him and take further action in accordance with law.

6. With the above directions, this Criminal Original Petition is disposed of.
