J U D G M E N T

(By D.Krishnakumar,J.,) This Writ Appeal has been filed, challenging the order of the learned Single Judge dated 06.05.2022 made in W.P.No.12036 of 2022, by which the Writ Petition filed by the Writ Petitioner/1st Respondent herein, was disposed of with a direction to consider his application dated 29.01.2022 within two weeks.

2. When the matter is taken up for hearing, it is represented by the learned counsel for the Bank/appellants herein that pursuant to the direction of the learned Single Judge, the Bank has already considered the representation of the Writ Petitioner and passed the final order and the said submission of the learned counsel for the Bank has not been refuted by the learned counsel appearing for the Writ Petitioner/R1 herein. It is further represented by the learned counsel for the Bank that since a legal issue is involved in this case with regard to the maintainability of the Writ Petition, the Bank has chosen to file the present Writ Appeal.

3. Admittedly, a final order has been passed in this case, consequent to the order of the learned Single Judge. As such, we are of the view that nothing survives for further adjudication in this case at the appellate stage. Hence, this Writ Appeal is dismissed by recording the submission of the learned counsel for the Bank that already 2/4

quietus has been given to the issue by passing a final order on the application of the Writ Petitioner as sought in the Writ Petition. In respect of the merits of the matter regarding maintainability of the Writ Petition, the issue is left open and the same would be decided in an appropriate case. No costs.
