The above petition is filed to condone the delay of 317 days in filing the above Second Appeal.

2. Though counter was not filed the learned counsel for the respondent submitted that the delay is inordinate. However, sufficient reasons have been given in paragraph no.7 of the affidavit filed in support of the petition.

Accordingly, the delay is condoned.

3. The Registry is directed to number the appeal, if otherwise in order.
