ORDER : The Court Made the following order :- (The case has been heard through video conference) The petitioner who was arrested and remanded to judicial custody on 31.10.2021 for the offences under Sections 394 and 397 of IPC, in Crime No.1174 of 2021, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused followed the de facto complainant and snatched his hand bag which was containing cash of Rs.80,000/- and assaulted him and escaped from the place in a two wheeler. Hence the complaint. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that co-accused has been granted bail by the lower Court and the petitioner has been suffering incarceration for more than 30 days from 31.10.2021 and he would pray for grant of bail to the petitioner.

4.The learned Government Advocate (Crl. Side) would raise strong objection stating that a gang of persons are involved in this case and A1 is still in custody. The petitioner is arrayed as A4 and that A7 and A8 are still absconding. Further, the stolen amount of Rs.80,000/- has not been recovered and the investigation is at the initial stage.

5.Considering the nature of offence and the fact that A7 and A8 are still absconding and the stolen amount has not been recovered and that the investigation is at the initial stage, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
