O R D E R

The instant writ petition has been filed with a prayer for issuing a Mandamus to direct the 1st respondent to pay interest for the delayed payments made to the petitioner in respect of Gratuity, Commutation, Provident fund and Earned Leave etc. and pass such orders accordingly. 2.The learned counsel for the petitioners would submit that the petitioners had retired on superannuation. However, their retirement benefit has been given belatedly without any interest. In this connection, the petitioners have sent representations to the respondent seeking interest for the belated payment of the terminal benefits such as Gratuity, Commutation, Provident fund and Earned Leave etc. However, there was no response for the same.

3. At this juncture, the learned Standing Counsel appearing for the respondent would fairly submit that they would pay interest @ 6% pa for the 2/5

belated payment of the terminal benefits as ordered in the writ petition.

4. Heard the learned counsel for both sides and perused the materials available on record.

In view of the said fair submission made by the learned Standing Counsel, without going to the merits of this Writ Petition, this Court deems it appropriate to direct the respondent to pay the interest @ 6% p.a. for the belated payment of the terminal benefits such as Gratuity, Commutation, Provident fund and Earned Leave etc. within a period of eight weeks from the date of receipt of copy of this order.

6.In the result, this Writ Petition is disposed of with the above directions. Consequently connected miscellaneous petition is closed. No costs.
