Prayer: Writ Petition filed under Article 226 of the Constitution of India praying for a Writ of Mandamus directing the first respondent to consider the representation of the petitioner dated 20.09.2011 and pass orders on merits and in accordance with law within a stipulated period.

ORDER

The petitioner was initially appointed as Grade II Constable on 13 May 1981. He was promoted as Head Constable and thereafter as Sub Inspector of Police. The petitioner was deputed to Motor Transport Department as Driver, after his appointment as Grade II Police Constable. While he was working in Motor Transport Department, his juniors were all promoted as Head Constables overlooking his name.

2. It is the grievance of the petitioner that he was not given option to continue as Driver in Motor Transport Department and it was https://hcservices.ecourts.gov.in/hcservices/

a unilateral action taken by the department. The petitioner submitted a representation dated 20 September 2011 requesting the respondents to consider his date of initial recruitment for fixing seniority and to give him due promotion. Since the said representation was not taken up for consideration, the petitioner is before this Court.

3. Heard the learned counsel for the petitioner and the learned Additional Government Pleader appearing on behalf of the respondents.

4. The second respondent is directed to consider and dispose of the representation of the petitioner dated 20 September 2011 in the light of the order dated 18 September 2007 in W.P.No.25043 of 2002. Such exercise shall be completed within a period of four months from the date of receipt of a copy of this order.

5. The petitioner is directed to forward a copy of the representation dated 20 September 2011 along with a copy of this order so as to enable the second respondent to dispose of the matter as expeditiously as possible.

6. The writ petition is disposed of with the above direction. No costs.
