Respondents Contempt Petition has been filed under Section 11 of the Contempt of Courts Act, 1971, to punish the respondents for disobeying the order, dated 15.09.2021, passed in W.A.No.1132 of 2021.

ORDER

Pursuant to the statutory notice issued on 09.11.2022, the respondents are present before this Court today. They have filed an affidavit, dated 07.12.2022, stating that the error that has been committed by them with regard to the name of the petitioner in Birth Certificate has been rectified, which fact has been accepted by the petitioner. They have also tendered unconditional apology, which is reflected in paragraph 2 of the affidavit and the same is accepted by this Court.

2. The only grievance of the petitioner is that she has been made to run from pillar to post to get her name corrected.

Learned counsel for the petitioner would submit that in view of the mistake committed by the respondents, the name of the petitioner has been deleted from the data/records and she is unable to travel abroad; that for no fault of the petitioner, the respondents have penalised the petitioner and, therefore, she may be given liberty to wok out the remedy available to her.

4. In contempt, we are confined only to see whether the order has been complied with or not. Considering the fact that the name of the petitioner has been corrected and the respondents have tendered apology, which has been accepted by this Court, we close this Contempt Petition. If the petitioner has any other grievance, it is open for her to work out the remedy in accordance with law. No costs. (S.V.N.,J.)
