This petition is filed to condone the delay of 64 days in preferring the appeal.

2.CMP against the third respondent stood automatically dismissed for not taking steps to bring on record the legal heirs of the third respondent.

3.Mr.P.Parthikannan, learned counsel for the respondent Nos.1, 2 and 4 has no objection for delay being condoned.

4.I have gone through the affidavit filed in support of this petition and I am satisfied with the reasons stated therein, therefore, the delay of 64 days in preferring the appeal is condoned.

5.Accordingly, this petition is ordered.
