G. CHANDRASEKHARAN, J., The petitioner namely Anandan, who apprehends arrest at the hands of the respondent police for the alleged offence under Sections 379 & 430 IPC, in Crime No.219 of 2023, on the file of the respondent police, seeks anticipatory bail.

2. It is the submission of the learned counsel for the petitioner that petitioner is an innocent person and he has been falsely implicated in this case. Thus, he seeks grant of anticipatory bail for the petitioner. 3.In response, the learned Additional Public Prosecutor opposed this petition and submitted that on 06.06.2023, at about 11.00 a.m., when the respondent police were in their routine vehicle check up, found a Tractor along with a trailer bearing registration No.TN 18 BY 4235, illegally transporting 1 unit of river sand without any valid permit. He further submitted that petitioner has no previous case pending against him. The investigation in this case is not completed. Thus, he prays for dismissal of this petition.

4. Considered the rival submissions and perused the materials available on record.

5. This is the second anticipatory bail petition. The earlier anticipatory bail petition filed by the petitioner in Crl.O.P.No.16884 of 2023 was dismissed on 02.08.2023. It is a case of theft of river sand, measuring 1 unit. The investigation in this case is not completed. Taking all these facts into consideration, this Court is not inclined to grant anticipatory bail to the petitioner.
