A.No.3993 of 2022 is filed to condone the delay of 81 days in filing application for set aside the abatement caused by the death of the plaintiff/R.Sunil Kumar.

2.A.Nos.3994 & 3995 of 2022 are filed for setting aside the abatement and for bringing on record the legal representatives of the deceased plaintiff R.Sunil Kumar.

3.This Court, posted these applications for filing the counter of the respondents in these applications. When the mater is taken up today, there is no representation for the respondents. Considering the nature and scope of these applications and that delay in filing the set aside abatement application is only 81 days and also considering that these legal representatives of deceased plaintiff R.Sunil Kumar are necessary parties to the suit, this Court allows all the three applications in A.Nos.3993, 3994 & 3995 of 2022. The learned counsel for the plaintiff is directed to take necessary steps for amending the plaint and file amended plaint.
