3 UDHAYAKUMAR Petition praying that in the circumstances stated therein the High Court will be pleased to extend the time to comply with the condition (Para 2) that the petitioner is directed to surrender before the trial Court within a period of two weeks from date of receipt of a copy of this order or after commencement of normal functioning of the Court, which ever is later and on such surrender, the learned Principal District Judge, Special Court for SC/ST (PA) Act 1989, Tiruppur, shall deal with the matter on the same day on merits and in accordance with law, after issuing notice to the victims under Section 15-A (3) of the SC/ST Act in Crl.OP. No. 18973 of 2021 dated 20.10.2021 and thus render justice. Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.P.KALIMUTHU, Advocate for the petitioner and of M/S. RAJ THILAK, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:-
This Criminal Miscellaneous Petition has been filed to extend the time for further two weeks to comply the order of this Court in Crl.O.P.No.18973 of 2021, dated 20.10.2021.
2. The learned counsel for the petitioner submitted that when the petitioner surrendered on 02.11.2021, the trial Court had returned the surety papers on the ground that the time limit was lapsed and hence, he could not comply the condition of executing the surety before the Principal District Judge, Special Court for SC/ST (PA) Act, 1989, Tiruppur. Therefore, he prays for extension of time to comply with the order of this Court.
3. Being satisfied with the reasons stated in the petition, this Court is inclined to grant two weeks time for surrender. The petitioner is directed to appear before the learned Principal District Judge, Special Court for SC/ST (PA) Act, 1989, Tiruppur, within a period of two weeks from the date of receipt of a copy of this order.
