O R D E R

The petitioner, who was arrested and remanded to judicial custody on 03.06.2025, for the offence punishable under Sections 336(2), 336(3), 319(2), 318(4), 62 r/w 3(5) of BNS, 2023 in Crime No.16 of 2025 on the file of the respondent.

2. It is the case of the prosecution that the petitioner was arrested and remanded to judicial custody on 03.06.2025. The petitioners along with other accused colluded together and created two settlement deeds and power of attorney in respect of the property which belongs to one Sadhana using fake Aadhaar cards. The said documents were fraudulently registered to swindle the property of the original owners. Hence, the present case. The learned counsel for the petitioner submits that he has been falsely implicated in this case. Neither the petitioner nor his wife have been shown as accused in the first information report. They have absolutely no role in the alleged crime. He further submitted that the Aadhaar card of the petitioner's wife was misplaced, for which the petitioner and his wife have been arrested in this case. He further submits that he is ready to abide any stringent condition imposed by this Court and further prayed to grant bail to the petitioner.

3. The learned Government Advocate (Crl. Side) strongly opposed for grant of bail to the petitioner stating that on the basis of the direction of this Court in W.P.No.1602 of 2025, the FIR has been registered. During investigation, it is seen that the petitioner and other accused have impersonated several persons and 2/4

created bogus documents and have made fraudulent registration. A1 to A4 were arrested. He further submits that custodial interrogation of the petitioner is required in this case.

4. The learned counsel for the intervenor strongly opposed to grant bail to the petitioner.

5. Considering the fact that custodial interrogation of the petitioner is required in this case, this Court is not inclined to grant bail to the petitioner.
