The petitioner who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections in 273, 328 of IPC r/w Section 20(2) of Cigarette and Tobacco Products Acts, 2003, in Crime No.107 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner and other accused were found in possession of 1425 packets of Hans. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence and he has been falsely implicated in this case. Hence he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl. Side) submitted that there are totally two accused in which the petitioner is arrayed as A2. The petitioner and other accused were in illegal possession of 1425 packets of Hans and the petitioner is having four previous cases similar in nature. 5. Though this Court dismissed the anticipatory bail petition on previous occasion, the petitioner has failed to surrender before the Respondent Police. Therefore, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, this Criminal Original Petition is dismissed with costs.
